These Terms and Conditions (“Terms”) govern:
(a) your use of our website; and
(b) your purchase of products from us via our website.

Please read these Terms carefully before placing an order.

Nothing in these Terms affects your statutory rights under UK consumer law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

“Business Day” means a day other than a Saturday, Sunday or public holiday in England.
“Order” means your order for Products placed via the Website.
“Products” means the goods offered for sale on the Website.

We do not accept responsibility for losses arising from communication with impersonators. If in doubt, contact us using the official emails above before taking any action.

3. USING THE WEBSITE

3.1 Personal use only
The Website is provided for your personal, non-commercial use. We may refuse or cancel Orders where we reasonably suspect resale, bulk buying for commercial purposes, or fraud.

3.2 Website availability and changes
We may update, change, suspend or withdraw the Website (in whole or part) at any time for business or operational reasons. We do not guarantee the Website will always be available, uninterrupted, secure or error-free.

3.3 Acceptable use
You must not misuse the Website. In particular you must not:
(a) introduce viruses, trojans or other harmful material;
(b) attempt to gain unauthorised access to the Website, servers or data;
(c) use automated systems (bots/scrapers) to access the Website without our permission;
(d) interfere with or disrupt the Website’s operation.

4. ACCOUNTS, ACCURACY AND SECURITY

4.1 Account information
If you create an account or place an Order, you must ensure all information you provide is true, accurate, current and complete, including delivery and contact details.

4.2 Security
You are responsible for maintaining the confidentiality of your account credentials. Please notify us immediately if you believe your account has been compromised.

5. PRODUCTS, DESCRIPTIONS AND SUITABILITY

5.1 Product information
We take reasonable care to ensure Product descriptions and images are accurate. However:
(a) images are illustrative and colours may vary depending on device/screen settings;
(b) packaging may change from time to time.

5.2 Cosmetics disclaimer
Our Products are cosmetic products and are not intended to diagnose, treat, cure or prevent any medical condition.
We recommend performing a patch test before first use and discontinuing use if irritation occurs. If you have a medical condition, allergy history, or concerns, please seek professional advice.

6. PRICES, VAT AND PROMOTIONS

6.1 Pricing and VAT
All prices are shown in GBP (£). Prices include UK VAT where applicable unless stated otherwise. Delivery charges (if any) are shown at checkout.

6.2 Errors
While we try to ensure all prices and information are correct, errors may occur. If we discover an obvious pricing or description error affecting your Order, we may:
(a) contact you to confirm whether you wish to proceed at the correct price; or
(b) cancel the Order and refund you in full.

6.3 Promotions and discount codes
Promotions and discount codes:
(a) are subject to stated terms, availability and expiry dates;
(b) have no cash alternative;
(c) cannot be combined unless we state otherwise;
(d) may be withdrawn or amended at any time.

We will not honour discount codes, promotions, or “special offers” distributed by third parties we are not affiliated with.

7. ORDERS AND CONTRACT FORMATION

7.1 Placing an Order
When you place an Order, you are making an offer to buy Products from us.

7.2 Order acknowledgement is not acceptance
An order confirmation/acknowledgement email does not mean your Order has been accepted.

7.3 When the contract is formed
A legally binding contract is formed only when we send you a dispatch confirmation email (or otherwise confirm dispatch).

7.4 Our right to refuse/cancel
We may refuse or cancel an Order before dispatch for reasons including (but not limited to):
(a) suspected fraud or unauthorised transactions;
(b) stock unavailability;
(c) errors in pricing or Product information;
(d) failure to pass verification checks;
(e) delivery restrictions.

If we cancel, we will refund amounts paid using the original payment method.

8. PAYMENT

8.1 Payment processing
Payments are processed via the payment methods displayed at checkout (including third-party payment service providers). You agree to comply with any applicable third-party payment provider terms when choosing that payment method.

8.2 Payment timing
Payment must be authorised and received in full before dispatch.

9. DELIVERY

9.1 Delivery territory
We deliver to the United Kingdom only (England, Wales, Scotland and Northern Ireland), unless we explicitly state otherwise.

9.2 Delivery times
Any delivery times shown are estimates only. We are not responsible for delays outside our reasonable control (e.g. courier delays, weather, peak periods).

9.3 Risk and title
Risk of loss/damage passes to you on delivery to the address specified in your Order.
Title (ownership) to the Products passes when we have received payment in full and the Products have been delivered.

10. YOUR RIGHT TO CANCEL (14-DAY COOLING-OFF PERIOD)

10.1 Your statutory right
If you are a UK consumer, you have the right to cancel your contract within 14 days of receiving the Products, without giving any reason.

10.2 How to cancel
To cancel, email us within the 14-day period at:

Please include your name and Order number.

10.3 Returning the Products after cancellation
You must return the Products to us within 14 days of telling us you want to cancel.

10.4 Refunds after cancellation
If you cancel within the cooling-off period, we will refund:
(a) the price paid for the Products; and
(b) the cost of standard delivery (if charged),
within 14 days of receiving the returned Products (or evidence you have sent them back).

If you chose an enhanced delivery option, we will not refund the additional cost beyond standard delivery.

10.5 Deductions for handling
We may reduce your refund if the Products have been handled beyond what is necessary to establish their nature, characteristics and functioning, resulting in diminished value.

11. RETURNS AND REFUNDS (NON-FAULTY ITEMS)

11.1 Returns policy (in addition to your statutory rights)
If you wish to return non-faulty Products, items must be:
(a) unused and in original condition;
(b) returned in original packaging, where applicable, with such packaging not materially damaged, including the Lernberger Stafsing product packaging, except to the extent necessary to examine the nature, characteristics and functioning of the Products.

11.2 Hygiene and sealed goods
For health and hygiene reasons, certain Products may not be suitable for return once unsealed (where legally permitted). If a Product is sealed and the seal is broken after delivery, we may refuse a return, except where the Product is faulty.

11.3 Return shipping costs
Unless the Products are faulty, damaged, or incorrect, you are responsible for return shipping costs.

12. FAULTY, DAMAGED OR INCORRECT GOODS

12.1 Your legal rights
Nothing in these Terms limits your rights under the Consumer Rights Act 2015.

12.2 What to do
If your Products are faulty, damaged on arrival, or not as described, please contact:

Provide your Order number and photos where possible. We will offer an appropriate remedy (replacement/refund) in accordance with UK law.

13. LIMITATION OF LIABILITY

13.1 Nothing in these Terms limits liability for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any matter for which it would be unlawful to exclude or restrict liability.

13.2 Website and content
To the extent permitted by law, the Website is provided “as is” and “as available”. We do not guarantee that the Website will be secure, free from bugs/viruses, or error-free.

13.3 Foreseeable losses
If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or negligence. We are not responsible for losses that are not foreseeable.

13.4 Excluded losses (to the extent permitted)
We are not liable for:
(a) business losses (loss of profit, revenue, business interruption); or
(b) losses arising from your misuse of the Website or breach of these Terms.

14. INTELLECTUAL PROPERTY

All content on the Website (including text, logos, images and design) is owned by or licensed to Lernberger Stafsing AB and/or Hawthorn Merchants Ltd and is protected by intellectual property laws. You may not copy, reproduce, distribute or exploit any part of the Website without prior written permission.

15. USER CONTENT AND REVIEWS

If you submit reviews, comments or other content, you must ensure it is lawful, accurate, and not misleading, defamatory or infringing. You grant us a non-exclusive, royalty-free licence to use such content for operating and promoting the Website (including displaying reviews), subject to applicable law.

16. PRIVACY AND COOKIES

We process personal data in accordance with UK GDPR and the Data Protection Act 2018. Please refer to our Privacy Policy and Cookie Policy on the Website.

17. THIRD-PARTY LINKS AND SERVICES

The Website may contain links to third-party websites or services. We do not control and are not responsible for third-party content, policies or practices.

18. FRAUD, IMPERSONATION AND SAFETY NOTICE (UK)

19. FORCE MAJEURE

We are not liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control (including courier disruption, industrial action, natural disasters, pandemics, or governmental actions).

We may update these Terms from time to time. The version in force at the time you place your Order will apply to that Order. Please check the “Last Updated” date at the top of this page.

21. COMPLAINTS AND DISPUTE RESOLUTION

These Terms are between you and us only. No other person has any rights to enforce any term of these Terms under the Contracts (Rights of Third Parties) Act 1999.

23. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
